Demerit Points

For all types of traffic offences in Queensland, demerit points apply and may be recorded on your traffic history.

Your traffic history is a record of any offences for which you’ve been found guilty relating to road rules, drink-driving, drug-driving, dangerous driving or vehicle registration.

Don’t lose your job because you can’t drive to work because you have accumulated too many demerit points!

How many demerit points can I accumulate?

If you hold a Queensland open licence you may receive a warning letter when you gain at least 7 demerit points in a 3 year period.

If 12 or more demerit points are recorded against your traffic history in a 3 year period, you will be sent an ‘Accumulation of Demerit Points – Notice to Choose’.

The choice is between:

  • having your open licence suspended for a requisite period, or
  • agreeing to continue driving under a period of good behaviour for 1 year.

Immediate Loss of Licence

Aside from suspension of your licence due to accumulation of demerit points, there are some scenarios whereby loss of licence can be immediate without demerit points.

For offences such as a high speed offence (which is define as going 40km or more over the speed limit), your licence will be immediately suspended for 6 months.

This applies to all types of licences.

If your licence is suspended but you still need to drive for work or some other reason, in limited circumstances you may be able to apply for a special hardship order
